Purposes and Legal Bases of Video Surveillance

On our company premises, we use video surveillance for various purposes with different scopes of functionality.

Video surveillance generally takes place for the pursuit of the following purposes or to safeguard the following interests:

  • Exercising house rights
  • Preventing criminal offenses
  • Supporting the establishment, exercise, or defense of legal claims
  • Protection against access by unauthorised persons
  • Surveillance of the premises to maintain building security
  • Coordination of visitors and reception operations
  • Protection against prevention of vandalism, burglary and theft
  • Detection of damage and theft and appropriate enforcement of claims for damages
  • Optimization of processes

Legal Basis

Safeguarding legitimate interests pursuant to Article 6 (1) (f) GDPR. Insofar as special categories of personal data are processed, this is carried out on the basis of Article 9 (2) (f) GDPR.

The legal basis applicable to a specific video surveillance system can always be found on the notice signs before you enter the monitored area.

Storage Period

Whether and for how long permanent storage of the data takes place depends on the respective purposes of the video surveillance. Video data is generally stored only for a short period of time and automatically overwritten. A longer retention period only occurs if a security-relevant incident is identified and the recordings are required as evidence. The specific storage period for the respective area can be found on the notice sign.

Recipients / Disclosure of Data

In the event of suspected criminal acts, we may also disclose the data to lawyers, insurance companies, and law enforcement authorities. Otherwise, data will only be disclosed if there is a legal basis for doing so. This may in particular be the case if the police or other security authorities act within the framework of so-called hazard prevention and request access to the video surveillance data.

As a rule, no transfer to third countries takes place. If, in individual cases, recipients located outside the EU/EEA are granted access, such transfer will only occur if the special requirements of Articles 44 et seq. GDPR are met, for example on the basis of an adequacy decision by the European Commission or through the use of the EU Standard Contractual Clauses, including appropriate additional safeguards.

 

Information on the rights of data subjects

The data subject has the right to request confirmation from the controller as to whether personal data concerning him or her are being processed; if this is the case, he or she has the right to information about these personal data and to the information listed in detail in Article 15 of the GDPR.

The data subject has the right to obtain from the controller the rectification without delay of inaccurate personal data concerning him or her and, where applicable, the completion of incomplete personal data (Article 16 GDPR).

The data subject has the right to obtain from the controller the erasure without delay of personal data concerning him or her, where one of the grounds listed in detail in Article 17 of the GDPR applies, e.g. where the data is no longer necessary for the purposes for which it was collected (right to erasure).

The data subject has the right to request the controller to restrict processing if one of the conditions listed in Art. 18 GDPR applies, e.g. if the data subject has objected to the processing, for the duration of the controller's review.
 
The data subject shall have the right to object at any time, on grounds relating to his or her particular situation, to the processing of personal data concerning him or her. The controller shall then no longer process the personal data unless it can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims (Article 21 GDPR).

Without prejudice to any other administrative or judicial remedy, any data subject shall have the right to lodge a complaint with a supervisory authority if the data subject considers that the processing of personal data relating to him or her infringes the GDPR (Art. 77 GDPR). The data subject may exercise this right before a supervisory authority in the Member State of his or her residence, place of work or the place of the alleged infringement.
